Hello. As some of you know im a chef. In may my boss / head chef and his wife / owner / restaurant manger are going on holiday for 17 days. There will be 4 in the restaurant and 2 in the kitchen. Does he expect us to work for 2 weeks with no days off ??? its not possible for 1 chef to be in the kitchen and the head waitress to be off on her days off. I do everything in the kitchen and the head chef only comes and helps when he has to. I do the ordering, the prep....
 
Anyway what are our rights ? We WILL turn round and say that we are not working our days off, there is a metting on Saturday after work although the bosses dont know it yet. All the staff are pulling together on this. What can they do ?

I wouldn't imagine anyone here can give you advice but why not contact the Citizens Advice Bureau ?

How many hours per week would you be working?
Does it contravene the maximum working hours limit? [Working Time Directive]
 
 
At the moment it's 48 hours but you are also entitled to minimum rest periods.
 
What does your contract say?

I work about 54 hours a week. I signed a piece of paper in my contract about my hours and that I agree that in this job, and most chef jobs that the hours will be longer than 48 hours per week, but I didnt sign anything stating that I would have no days of.

Hi mavestar,

 No one can make you work ALL you days off. While working at stansted my opposite number was off work on holiday and it was pointed out by the upper management that in my contract it states i will cover him as he has to me when on holidays, that would of ment i was working 72hours and after one quick call to the T&G union i was told that part off my contract but it wasnt able to be inforced by law.

I compromised and worked a 6 day week Approve which seemed resonable. If you are not in a union as mutley said give the CAB a call or even the jobcentre may be able to gie you the info

Rather than the CAB or meeting with other workers, why not have a chat with the management? Easiest thing to do is ask nicely what they plan to do in terms of cover while they are away. You may find that they are under the assumption (rightly or wrongly) that what they pay you is sufficient to cover for while they are away. Legally, the only 'days off' you are entitled to are statutory holidays (20 days per year). In theory, if you contract out of the 48hr week and work 8 hrs per day, every day of the week (56hrs per week), the only 'days off' are your annual leave and bank holidays.
 
Bottom line is to speak to management and come to an arrangement.

Hi,

What is the legal maximum you can work in a week? As long as you're not breaking that, and whilst it is very bad for your employer to cancel your days off, I don't think there is anything illegal in it. It just isn't moral, and certainly a very bad way to treat your staff.

Is that whilst they're on holiday? Why can't you cope with those numbers? Have they explicitly canceled your days off?

Basicly 2 in the kitchen... He is from Slovakia, cant do the ordering and then there is me who will be working all the time, sometimes for 12 hours a day. In the restaurant there will be 4, the head waitress, an Italian, and then two part timers. This is no way to run a 60+ seater restaurant. Everyone is going to be tired and moody, ahhh its just a mess. Never mind. I have put it behind me now and will just get on with it. Confused
